General Service Terms and Conditions
These Terms and Conditions of Service (“Terms”) govern the entirety of the services provided by Easy Logistics Pty Ltd (ABN 98 651 065 235) located at Melbourne, VIC, 3030, Australia, including but not limited to transportation, storage, handling, packing, unpacking, freight forwarding, customs clearance, and any other operations related to the transport and logistics of goods (“Services”).
These Services are provided by Easy Logistics Pty Ltd, its parent, affiliates, successors, assigns, employees, agents, and subcontractors, collectively referred to as “Easy Logistics” to its clients, who may be individuals, corporations, shippers, consignors, owners of the goods, consignees, receivers, or any authorized agents (“Clients”).
These Terms, which exclude any other conditions that may appear on documents issued by the Client unless expressly agreed upon in writing by an authorized officer of Easy Logistics, are binding. Clients are advised to regularly review these Terms on our website for any updates or changes.
Application of Terms
These Terms apply to all Services provided by Easy Logistics to the Client, ensuring that all rights, immunities, and limitations of liability herein remain effective even in the event of a contract breach by Easy Logistics or any other entitled party under these provisions.
Clients own terms and conditions shall not override these Terms, and any conflicting terms provided by the Client will be considered null to the extent of the inconsistency.
Not a Common Carrier
Easy Logistics does not operate as a common carrier and assumes no liability as one. We reserve the right to refuse the carriage or transportation of goods for any individual or corporation and to determine the class of goods we transport at our sole discretion.
Warranties and Undertakings by the Client
The Client guarantees compliance with all relevant laws and regulations regarding the goods’ nature, condition, packaging, and transportation. This includes accurate goods description on consignment notes or through Easy Logistics’ electronic systems, and acknowledgment of ownership or authorized agency over the goods. The Client also agrees to inform Easy Logistics of any shipments exceeding AUD $50,000 in value prior to dispatch.
The Client, including third-party claims, indemnifies easy Logistics against any costs or losses due to legal compliance or breach of these warranties.
Service Performance
Easy Logistics reserves the right to select the methods of performing the Services and to deviate from any instructed routes or methods as necessary.
Delivery
Delivery methods and terms are at Easy Logistics’ discretion, with efforts made to adhere to Client specifications. Failure to deliver due to receiver absence or other issues will result in storage and handling charges at the Client’s risk and expense.
Responsibility for Charges
Clients are obligated to pay all charges related to the Services upon issuance of an invoice, irrespective of delivery status or condition of the goods. This includes customs duties, excise costs, and any penalties or additional expenses arising during transport or storage.
Carrier’s Liability
Easy Logistics limits its liability for any loss, damage, or delivery issues to the lesser of re-supplying the Services, the cost of re-supply, or A$100. International shipments are subject to respective conventions limiting liability.
Insurance and Parcel Protect Cover
Insurance coverage for goods in transit is the responsibility of the Client, though Easy Logistics offers extended warranty options for domestic transport.
Notice of Loss and Time Bar
Claims for loss or damage must be made within 14 days of delivery, or when the goods were expected to be delivered, with legal action required within six months to avoid liability discharge.
Lien
Easy Logistics has the right to sell goods under lien if charges are unpaid, using sale proceeds to cover owed amounts and expenses.
Additional Provisions
Includes handling of dangerous goods, subcontracting rights, GST implications, modifications for consumer and small business contracts, and jurisdictional governance by laws.
Privacy
Client information will be handled in accordance with Easy Logistics’ Privacy Policy available on our website.
Severability
If any part of these Terms is found to be unenforceable, it will be modified or removed without affecting the rest of the Terms.
Governing Law
The laws of Australia and the state or territory in which the Main Contractor operates shall govern this Agreement.
